This present document is an agreement between Studio Akzynth (akzynth.com) also possibly refered as "Akzynth Studio", "website", "Shop", "Store", "us", "we" or "our", and the "User" as well defined as "Visitor", "Customer", "You" or "your".

Akzynth Studio (via akzynth.com) owns and operate this Website. Access to and use of the Website and the products and services available through it (collectively, the "Services") are subject to the following terms, conditions and notices (the "Terms of Service"). By using the Services, you are agreeing to all of the Terms of Service. We reserve the right to update and adapt this Terms of Service at any time. We recommand to the visitor to check this page regularly to take notice of any changes we may have made to the Terms of Service. If for any reason the Visitor doesn't agree with some of the rules of this Terms of Service, we invite him to stop immediately the use of the Website and its Services.

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.

Studio Akzynth respects your privacy and your personal datas and permits you to access to your informations and modify them. By using this Website, you consent to the processing described therein and warrant that all datas provided by you are accurate.

The intellectual property rights in all software and content (including texts, logos, images, artists designs...) made available to you on or through this Website remains the property of Studio Akzynth (akzynth.com) or its licensors (artists, designers and partners), and are protected by copyright laws and treaties around the world. All such rights are reserved by Akzynth and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

By placing an order you are offering to purchase one or several products on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

In order to contract with Studio Akzynth (via akzynth.com) you must be over 18 years of age and possess a valid payment method issued by a bank or a payment gateway (i.e. Paypal...) acceptable to us. Studio Akzynth (via akzynth.com) retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be Studio Akzynth (or akzynth.com) or may in some cases be a third party. Where a contract is made with a third party, Studio Akzynth (akzynth.com) is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the payment method used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

When you place an order, you will receive an notification e-mail confirming receipt of your order with a summary of it. This email will only be an acknowledgement and will not constitute an acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the products which you ordered have been dispatched to you. Only those articles listed in the confirmation e-mail sent at the time of dispatch will be included in the formed contract of sale.

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

The displayed prices include VAT with the rate applicable in Germany for the concerned products.

Delivery costs may be charged in addition, such additional charges are clearly displayed where applicable and included in the total amount.

Upon receiving your order, we carry out a standard authorization check on the payment gateway (i.e. Paypal) to ensure there are sufficient funds to fulfil the transaction. Your order will be processed, after acceptance, when the full payment of the value of the goods you wish to purchase will be received.

Until the full payment for the total amount of the order has been received definitively, all the goods from this order remain the sole property of Studio Akzynth.

We keep the right to deny or cancel any order for any reason and at our sole discretion. Your order may be cancelled due to, but is not limited to, limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or credit or fraud problems. You will be contacted by us if any portion of your order is canceled or if additional information is needed to proceed your order. If your order is canceled after the payment has been made, the amount of the order will be completely refunded.

A limitation of the quantity of articles purchased might be possible. These restrictions may be applicable to orders placed by the same customer account. Then the customer may be notified by email that some limits may be applied. We also reserve the right to deny sales to companies that we could consider as unauthorised dealers. Albania, Andorra, Argentina, Australia, Austria, Belgium, Bosnia and Herzegovina, Brazil, Bulgaria, Canada, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, French Guiana, French Polynesia, Germany, Greece, Guadeloupe, Hong Kong, Hungary, Ireland, Italy, Japan, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Martinique, Mexico, Monaco, Montenegro, Netherlands, New Zealand, North Macedonia, Norway, Poland, Portugal, Romania, Russia, Saint Barthélemy, Saint Martin (Dutch part), Saint Martin (French part), Saint Pierre and Miquelon, San Marino, Serbia, Singapore, Slovakia, Slovenia, South Korea, Spain, Sweden, Switzerland, Turkey, United Kingdom (UK) & United States (US).

The shipping costs may vary according the quantity of articles, the weight of the parcel, the destination and the carrier. The shipping costs are automatically calculated depending on these parameters and are displayed in the Cart and Checkout sections. These fees are included in the total amount of the order. The shipping costs may be modified without any notice due to the fact of the carrier. In the eventuality that the shipping costs are updated by the carrier after the order has been validated or confirmed, you will be contacted and invited to accept the updated price or cancel your order.

The Customer must pay attention to fill carefully all the fields of the delivery form in the Checkout section and Customer Account (if subscribed), including the delivery address and a landline or mobile phone number. Neither Studio Akzynth nor the carrier can be held responsible in case of delivery failure due to inaccuracy or error in the delivery address. In case of failure to deliver on the day of appointment because of inaccurate information, lack of access or of the absence of the Customer, some extra delivery costs may be charged. The Customer will be contacted and invited to pay for the new shipping before any re-delivery of the parcel. In case of non-payment of these fees, Studio Akzynth reserves the right to suspend the delivery of the product. All the annoyances resulting to these constraints will also be borne by the Customer.

The shipping delays, displayed in the Checkout section, are automatically calculated regarding the availability of the products, the working days and the estimated delivery time needed by the carrier to reach the final destination. In case of delay of more than 7 days of delivery indicated on the Checkout Section, and for any reason other than force majeure, the Customer is invited to notify Studio Akzynth by email and post mail with acknowledgement of receipt at the latest within 30 working days following the planned delivery date. The order will be canceled upon receipt of the letter if the parcel has not been delivered between the sending and receipt of the mail. In this case the monies will be totaly refunded within 30 days after the reception of the post mail.

Studio Akzynth allows their Customers to cancel an order, return or exchange a product. The cancellation or the return requests must be notified to Studio Akzynth as soon as possible and within 14 days from the date of delivery at the latest. The product, if delivered, has to be shipped back during this lapse of time. Studio Akzynth reserves the right to decline a return if the product has been damaged, altered, used; washed or worn for the garments; as well as framed, stretched or cropped for the prints. The shipping costs for any returns are the responsability of the Customer. Some articles customised or discounted may not be eligible for returns (except in case of legal warranty). The products delivered by Akzynth are guaranteed against manufacture defects for a limited period of two years. Normal wear, intensive or inappropriate wash, or misuse of the product are not covered by the legal warranty. Customisations, stains or holes resulting from the action of the Customer or their environment may void the legal warranty.
To use the legal guarantee, the Customer must notify Studio Akzynth about the defect when it occurs. When the warranty procedure is applicable to the defect product, the replacement of the product (same model and colors and size) is proposed to the Customer. If the remplacement is not possible, a voucher is issued to the Customer. A refund can be conceded only in some cases, after acceptance by Studio Akzynth. Regarding the warranty procedure, the shipping and return costs are at the charge of Studio Akzynth.

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law Studio Akzynth (akzynth.com) and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect Studio Akzynth's liability for death or personal injury arising from its negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

Studio Akzynth cannot be liable or deemed to have made any mistake in the processing of your order if delays or failures result from a force majeure circumstance.

These are considered fortuitous events or force majeure exempting all responsibility of all happenings or irresistible and unforeseeable circumstances beyond the control of the parties notably in the event of total or partial strike of transportation, conflict or war, terrorism, and natural or industrial disasters.

You may link to our Website (akzynth.com), provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. This Website must not be framed on any other site, nor may you create a link to any part of this Website other than the home page. We reserve the right to withdraw linking permission without notice.

You agree to indemnify, defend and hold harmless Studio Akzynth (akzynth.com), its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this Website or your breach of the Terms of Service.

Studio Akzynth (akzynth.com) shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

At Studio Akzynth we are very solicitous over the quality of our products and services and we will always do our best to satisfy our customers and partners. The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between You and Studio Akzynth (akzynth.com). Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by an executive of Studio Akzynth.
